This website/application is owned and operated by Topho technology and services OPC Pvt Limited a Company registered under the Companies Act, 2013, having its registered office at B-55, Buddha Colony, Patna (“Company”). Any reference made to “We”, “Our” and “Us” shall hereinafter refer to the Company. Any user of the website/application shall be termed as the “User” and any reference to “You”, “Your” and “Yourself” shall hereinafter refer to the User.

This Refund and Cancellation Policy (“Policy”) establishes a legally binding agreement between You and the Company.

You agree that Your use of Our website/application shall be subject to this Policy and all other policies which are published on Our website/application.

We reserve the right at Our sole discretion to edit/modify/amend/alter/revise this Policy from time to time. We will notify you about such revisions if and when they are made.

Your continued use of Our website/application will be inferred as Your acceptance to this Policy or any modifications and alterations which have been made to the same.

Refund

Refund of the Commission paid to the Platform

The Commission charged and retained by the Platform is non-refundable and shall not be refunded at any point of time, despite cancellation of  the service.

Refund of the Commission paid to the Photographers

The Customers, subject to any terms agreed with the Photographers, may request for a refund of the amount paid (except for the commission amount as charged and retained by the Platform), within 30 days of the payment of the amount. The refund can only be claimed for the following reasons, and no reason whatsoever:

1. The Photographer has unduly delayed the delivery of services (“Undue Delay” shall mean and include delay of more than 15 days from the committed date of delivery).
2. The Photographer failed to deliver the Services completely.
3. The Photographer breached any applicable law while delivering the services.

Apart from the aforementioned, no other ground of refund shall be entertained. Any refund request, raised, post 30 days of the payment of the amount, shall not be considered valid.

Severability

If any provision of this Policy becomes invalid or unenforceable due to whatsoever reason, such invalidity or unenforceability shall not lead to the entire agreement becoming unenforceable. The unenforceable or invalid portion shall be deemed to be severed from the Policy without affecting the validity of the entire Policy.

Governing Law and Jurisdiction

All matters, claims and any other such issues which may directly or indirectly arise from or in connection with this Policy shall be governed under the laws of India. The courts at Patna shall have the sole and exclusive jurisdiction to hear all matters, claims or any such issues which may directly or indirectly arise from or in connection with the Policy.
